What information do we collect?

We process data enabling us to get in touch with you ("contact data"). The contact data may include your name, email address, telephone number, postal address and/or social media account identifiers. The source of the contact data is you and/or your employer. If you log into our website using a social media account, we will obtain elements of the contact data from the relevant social media account provider.

We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

We process data about your use of our website and services ("usage data"). We use your personal data for the purposes of fulfilling our contract with you, or because you have made an enquiry or asked us to do something for you. This information may include your name, phone number, email address, home address and project information.

We process usage data and/or transaction data for the purposes of researching and analysing the use of our website and services, as well as researching and analysing other interactions with our business.

We process your personal data for the purposes of creating and maintaining our databases, back-up copies of our databases and our business records generally. The legal basis for this processing is our legitimate interests, namely ensuring that we have access to all the information we need to properly and efficiently run our business in accordance with this policy.

 

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To save or protect an individual's vital interest. We may process your information when necessary to save or protect an individual’s vital interest, such as to prevent harm.

  • Potential Job Vacancy Assessment. To assess users job applications (CV & Portfolio)

In relation to a contract, we have with you we only share your personal data to other people/organisations who have a direct (legitimate) relevance/ interest in your project. For example, when we obtain quotes on your behalf, e.g. for a civil engineer, ecological consultant or an M&E consultant quote. These organisations will all have their own policies on how they deal with personal data.

As part of the registration process for our mailing list, we collect personal information. We use that information for a couple of reasons: to give you updates about Kelly Studio Architects; to contact you if we need to obtain or provide additional information and to check our records are right.

 

What legal basis do we have for processing your personal data?

We have contracts in place with our third parties, which are designed to help safeguard your personal information. This means that they cannot do anything with your personal information unless we have instructed them to do it. They will also not share your personal information with any organisation apart from us. They also commit to protect the data they hold on our behalf and to retain it for the period we instruct. The categories of third parties we may share personal information with are as follows:

  • Data Analytics Services

We also may need to share your personal information in the following situations:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

  • When we use Google Maps Platform APIs. We may share your information with certain Google Maps Platform APIs (e.g. Google Maps API, Places API). You may revoke your consent anytime by contacting us at the contact details provided at the end of this document.

We may transfer your personal data from the European Economic Area (EEA) to the UK and process that personal data in the UK for the purposes set out in this policy, and may permit our suppliers and subcontractors to do so, during any period with respect to which the UK is not treated as a third country under EU data protection law or benefits from an adequacy decision under EU data protection law; and we may transfer your personal data from the UK to the EEA and process that personal data in the EEA for the purposes set out in this policy, and may permit our suppliers and subcontractors to do so, during any period with respect to which EEA states are not treated as third countries under UK data protection law or benefit from adequacy regulations under UK data protection law.

 

Where do we store and process personal data?

The Data is processed at the Owner's operating offices and in any other places where the parties involved in the processing are located. Depending on the User's location, data transfers may involve transferring the User's Data to a country other than their own.

We aim to protect your personal information through a system of organisational and technical security measures.

We store your personal information securely & use appropriate measures to protect it from unauthorised access, alteration, or destruction. The recipient computer/device/email is protected by password encryption.

How long do we keep your personal data for?

We keep your information for as long as necessary to fulfil the purposes outlined in this privacy notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than 6 years, unless the following paragraph applies.

We use external vendors and hosting companies to provide the software, hardware, storage, networking and other necessary technology required to provide the service. If we have a current contract, or have had in the past, or you have asked us to undertake work for you, we are required to keep your data. In this instance, we keep your data for 12 years, this is in part due to the legalities of building contracts.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
